Section 1: DEFINITIONS

  • Business Days – days from Monday to Friday, excluding public holidays.
  • Consumer – an individual making purchases in the Store, as defined by the Civil Code.
  • Buyer – an individual, legal entity, or organizational unit making purchases in the Store.
  • Terms and Conditions – this document outlining the rules for using the Store.
  • Store – the online store “Płomień” operated by the Seller at https://plomien.eu
  • Seller – Weronika Wolińska

Section 3: TECHNICAL REQUIREMENTS

To use the Store, the following are required:

  • A device with Internet access,
  • A web browser supporting JavaScript and cookies,
  • An active e-mail account.

Section 4: PURCHASES IN THE STORE

  • All prices in the Store are gross prices (including VAT).
  • The total order price includes the cost of the goods and delivery charges (if applicable).
  • To make a purchase, add the selected products to the cart and follow the instructions on the Store’s website.
  • An order is placed upon confirmation of the order details and acceptance of the Terms and Conditions by the Buyer.
  • The sales contract is concluded at the moment the order is placed.
  • Confirmation of the concluded sales contract will be provided to the Consumer on a durable medium.

Section 5: PAYMENTS

  • The Buyer may choose one of the available payment methods:
    • via the SureCard payment platform (to pay with card, Apple Pay or BLIK)
  • In the case of prepayment, the Buyer is obliged to complete the payment within 1 business day of placing the order.
  • Some payment methods may require immediate settlement of the amount due after placing the order.
  • The Buyer agrees to receive electronic invoices, and this consent may be withdrawn at any time.

Section 6: ORDER FULFILLMENT

  • The Seller undertakes to deliver goods without defects.
  • The order fulfillment time is specified in the product description.
  • Order processing begins after the payment has been received, if the Buyer has chosen prepayment.
  • If the order includes products with different processing times, the order will be shipped at the latest possible time.
  • Delivery is made within Poland and is carried out according to the method chosen by the Buyer: courier or personal collection.
  • Delivery costs depend on the weight and size of the package as well as the delivery method.

Section 7: RIGHT OF WITHDRAWAL FROM THE CONTRACT

  • The Consumer may withdraw from the contract within 30 days without providing a reason, subject to Section 8 of these Terms and Conditions.
  • The withdrawal period runs from the day the Consumer receives the goods.
  • To exercise the right of withdrawal, the Consumer must inform the Seller (e.g., via e-mail) of their decision.
  • The Consumer may, but is not obliged to, use the withdrawal form provided as an attachment to these Terms and Conditions.
  • The Seller will refund the payment within 14 days of receiving the returned goods.

Section 8: EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FROM THE CONTRACT

The right of withdrawal does not apply to the Consumer in relation to contracts:

  • for the provision of services, if the Seller has fully performed the service with the Consumer’s consent,
  • for the delivery of goods made according to the Consumer’s specifications,
  • for the delivery of goods liable to spoil quickly,
  • for the delivery of audio or video recordings in sealed packaging, once unsealed.

Section 9: COMPLAINTS

  • The Buyer has the right to complain about defective goods under the provisions of the Civil Code concerning warranty of quality.
  • Complaints should be sent to the address provided in Section 2.
  • In the case of a justified complaint, the Seller bears the cost of returning the goods.
  • Complaints regarding the operation of the Store may be submitted via e-mail to the contact address provided in Section 2.

Section 10: PERSONAL DATA

  • The Seller is the data controller for the personal data of Buyers.
  • Details regarding the processing of personal data are available in the Privacy Policy on the Store’s website.
  • Providing personal data is voluntary but necessary to execute the sales contract.
  • The Buyer is entitled to rights related to the processing of personal data, such as access, correction, deletion, transfer, and the right to object to the processing.

Section 11: RESERVATIONS

  • It is prohibited to provide content of an unlawful nature.
  • Each order placed in the Store constitutes a separate sales contract and requires acceptance of these Terms and Conditions.
  • All contracts are concluded in the Polish language.
  • In the event of a dispute with a Buyer who is not a Consumer, the competent court will be the court having jurisdiction over the Seller’s registered office.
  • The provisions concerning goods apply accordingly to digital content.
