Welcome to the Plomien Store. The terms “we,” “us,” and “our” refer to the brand Plomien, operated by DREWOL Wojciech Woliński, REGON: 930375852, NIP: 9161000501, based in Dziewiętlin 1A, 56-320 Krośnice, Poland (“Seller”).

These Terms and Conditions (“Terms”) together with our Privacy Policy govern your access to and use of our online store, including all related information, content, features, tools, products, and services (the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Section 1 — Eligibility and Account

By agreeing to these Terms, you confirm that you are of legal age in your jurisdiction, or you have given us consent to allow any minor dependents to use the Services.
You may be asked to provide information such as your name, email, billing and shipping details, and payment data. You represent that all information provided is accurate and complete.
You are responsible for maintaining the confidentiality of your account and password. You must not sell, transfer, or license your account to others.

Section 2 — Products

We strive to display products accurately. However, colors and appearances may vary depending on your device settings.
We do not guarantee that product quality will meet your expectations.
Product descriptions, prices, and availability are subject to change without notice.

Section 3 — Orders

Placing an order constitutes an offer to purchase. We may accept or reject any order at our discretion.
Orders are confirmed only after we receive and process payment.
Please check your order carefully before submission; cancellation requests may not be accepted once an order is confirmed.
Returns and exchanges are governed by our Return Policy.
You confirm that all purchases are for personal use and not for resale or export.

Section 4 — Prices and Payments

Prices shown include VAT (where applicable). Shipping, customs, or additional fees may apply.
The price charged is the one applicable at the time the order is placed.
Payment options include credit card, Apple Pay, BLIK, and other methods offered via SureCard.
By providing payment information, you confirm that you are authorized to use the chosen payment method.

Section 5 — Shipping and Delivery

Delivery times are estimates only and not guaranteed. We are not responsible for carrier delays or customs clearance issues.
Risk of loss and title pass to you once the order is handed to the carrier.
Delivery is available within Poland and internationally, depending on available shipping options.

Section 6 — Right of Withdrawal (EU/EEA Consumers)

Consumers within the EU/EEA have the right to withdraw from the contract within 30 days without giving a reason.
The withdrawal period starts from the day the goods are received.
To exercise this right, you must notify us by email: contact@plomien.eu.
You may (but are not required to) use the withdrawal form included in Attachment No. 1.
Refunds will be issued within 14 days of receiving the returned goods.

Exceptions to the Right of Withdrawal:

The right does not apply to contracts for:

goods made to the Consumer’s specifications or clearly personalized,
perishable goods,
sealed goods unsealed after delivery (e.g., audio, video, software),
services fully performed with prior Consumer consent.

Section 7 — Complaints

If goods are defective, you may file a complaint under applicable warranty provisions of the Civil Code.
Complaints must be sent to our contact address.
If the complaint is justified, we will bear the cost of returning goods.

Section 8 — Intellectual Property

All trademarks, logos, texts, images, and designs in the Services are owned by Plomien or licensors.
You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.

Section 9 — Third-Party Tools and Links

We may provide access to third-party tools “as is” without warranties.
Our Services may contain links to external websites. We are not responsible for their content or practices.

Section 10 — Relationship with Shopify

Our store is hosted on Shopify Inc., which provides the e-commerce platform. While Shopify enables transactions, your purchases are contracts directly with Plomien (DREWOL Wojciech Woliński). Shopify bears no responsibility for any disputes, damages, or losses resulting from your purchases.

Section 11 — Feedback

By submitting feedback, suggestions, or ideas, you grant us a worldwide, royalty-free license to use, modify, and distribute such feedback for business purposes without obligation to you.

Section 12 — Errors and Inaccuracies

We reserve the right to correct errors, inaccuracies, or omissions at any time without notice, even after an order has been placed.

Section 13 — Prohibited Uses

You agree not to use the Services for unlawful purposes, including but not limited to fraud, harassment, spreading viruses, infringing intellectual property, sending spam, or attempting to bypass security.

Section 14 — Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms.

Section 15 — Disclaimers

Unless expressly stated otherwise, the Services and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

Section 16 — Limitation of Liability

To the maximum extent permitted by law, Plomien (DREWOL Wojciech Woliński) and Shopify shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services or products.

Section 17 — Indemnification

You agree to indemnify and hold harmless Plomien, Shopify, and their affiliates from any claims, damages, or expenses resulting from your breach of these Terms.

Section 18 — Governing Law

These Terms shall be governed by and construed under the laws of Poland. Any disputes shall be subject to the jurisdiction of the courts located in Poland.

Section 19 — Changes to Terms

We may update these Terms at any time by posting changes on our website. Material changes will be communicated as required by law. Continued use of the Services constitutes acceptance of the updated Terms.
